CALIFORNIA CHECKPOINT ALERT DIGEST: New Year’s Eve Weekend Edition December 31, 2010

It’s that favorite time of year for tax generation off the backs of distracted holiday motorists. Remember, they need a court order to take your breath test, there must be an escape route to avoid the checkpoint, and answer only when asked, don’t volunteer any new information. This is NOT legal advise, but just a reminder of what other attorneys have written before.

For additional checkpoints, check your local news station and the police department press releases. They are required to release the information in advance according to California Law.

October 29, 2010 (Friday) – Sobriety Checkpoint in Van Nuys Area at Ventura Boulevard and Columbus Avenue from 8 p.m. to 2 a.m.

October 30, 2010 (Saturday) – Sobriety Checkpoint in Hollywood Area at Hollywood Boulevard and Gower Street from 8 p.m. to 2 a.m.; and,

October 31, 2010 (Sunday) – DUI Saturation Patrol in Harbor Area from 2 p.m. to 10 p.m.

Remember, in California, they must provide a turn-around area so that you don’t have to go through the checkpoint at all. Also, if you do the research, you can find lots of DUI attorney advice on the web about how to conduct yourself on a DUI stop. It is common knowledge that you do not have to cooperate with field sobriety testing. Personally, I would not cooperate with any of it. “I do not consent to a search of my person, nor my property. I reserve my right to silence.”

Ontario police to conduct checkpoint

Ontario police will conduct a DUI/driver’s license checkpoint Friday from 6 p.m. to 2 a.m. Saturday.

Officers will focus on stopping impaired motorists and traffic law enforcement, according to an Ontario police press release.

Funding for the program was provided by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

Ontario police urge the public to dial 911 if they spot a suspected drunk driver.

Also, the ID portion of the checkpoint is illegal according to case law (they’re BOTH illegal according to the Constitution!), there’s an unconscionable profit motive for conducting these checkpoints due to the revenue generated by car seizures (no judge, no jury, no due process — they just take your car!) and the money trail for these checkpoints always leads back to federal sources.

Once again, the LAPD will be wasting your tax dollars with a DUI/Driver’s License Checkpoint tonight Friday Oct. 22 from 8 P.M. – 2 A.M. at Florence Avenue between Broadway and Main Street Los Angeles.

We all know that this isn’t about finding drunk drivers as very few impaired drivers are found through these checkpoints. Second, these checkpoints require a huge outlay of resources as most of the officers involved are on overtime. Third, studies have shown that police on regular patrol duty have a better chance of keeping drunk drivers off the road than police officers who conduct DUI checkpoints.

At any rate, if you don’t want your time as well as your money wasted, stay away from the above area tonight.

Thanks to Jay for the heads-up on this one. Good lookin’ out, Jay! ‘Preciate it!

If you are unfortunate enough to get cited for one of these, please fight it. This is supposed to be an “add-on” type of citation, not an actual reason to pull people over!

For example, one time I got cited for not having a front license plate & when I called in to delay the court date (so I would have more time to prepare my case), the person I spoke to said the citation was improperly issued & dropped it on the spot. I didn’t even have to appear!

Police State Alert!

Today, October 5th, the LAPD will be conducting a “zero tolerance” crackdown on drivers texting or using cellphones without a hands free device. While the police always claim this is about “safety”, it’s usually really about revenue as all drivers caught in this sweep will be cited without exception. Another “zero tolerance” crackdown on drivers will be held on the 26th of October as well.

Paso Robles conducting DUI checkpoint for Labor Day weekend

Paso Robles Police Department is reminding its residents to designate a sober driver this Labor Day weekend.

Officers are enforcing their message with a DUI/CDL checkpoint on Sunday from 6:00 p.m. until 2:00 a.m. in Paso Robles.

Paso Robles Police, along with other law enforcement agencies across the state, received a “Mini-Grant” from the California Office of Traffic Safety to conduct DUI/CDI checkpoints throughout the year.

The location of this weekend’s checkpoint will not be announced, but police said they plan to pull over every driver who passes through.

Arroyo Grande Police announce where DUI checkpoint will be held

Arroyo Grande Police Department announced where its DUI checkpoint will be Saturday evening.

It begins at 8:00 p.m. and will go until 2 a.m. Sunday morning.

The checkpoint will be on the Eastbound 1200 block of East Grand Avenue.

Officers said that traffic permitting they will pull over every driver who passes through that stretch.

CHP announces location of Saturday DUI checkpoint in Santa Barbara

The California Highway Patrol is conducting a sobriety/driver license checkpoint Saturday from 10:00 p.m. until 2:00 a.m. on Chapala Street between Gutierrez Street and Haley Street in Santa Barbara/Goleta area.

Drivers approaching the checkpoint will see signs instructing them that the checkpoint is ahead. Traffic volumes permitting, all drivers will be subject to a search. If volume increases, the CHP said they will select cars by a pre-set standard. i.e. every 3rd or 5th car.

Once pulled over, an officer will explain the purpose of the checkpoint and ask for a driver’s license.

Sobriety & Drivers License Checkpoint

When:
Friday, July 9, 2010
8:00 p.m. – 3:00 a.m.

Where:
Sunset Boulevard at Sutherland Street
Los Angeles, California

Who:
Emergency Operations Division

Why:
The purpose of the sobriety checkpoint is to reduce the number of traffic collisions involving intoxicated drivers and hit and run collisions. In 2010, residents residing in the Northeast Area have endured 42 driving under the influence-related and 504 hit and run traffic collisions. The checkpoint will educate the community to use designated drivers and not drink and drive. Our message is simple: If we catch you drunk, you will be arrested.

It is the Los Angeles Police Department’s goal to continue providing public awareness on the dangers of drinking and driving, and the laws concerning driving without a valid driver’s license. Motorists approaching a checkpoint will observe traffic signs, information and police officers advising that a checkpoint is ahead. Once diverted into a lane, each motorist will be detained momentarily while an officer explains the purpose of the checkpoint.

Funding for this checkpoint is provided by the California Office of Traffic Safety through the National Highway Traffic Safety Administration. We can all help make our streets safer, please report Drunk Drivers – Call 911.

WHY:
The purpose of the DUI saturation patrols is to reduce the number of traffic collisions involving intoxicated driver, as well as the number of hit-and-run traffic collisions. The Los Angeles Police Department seeks to achieve these goals through enforcement and public awareness.

These DUI saturation patrols are being deployed in response to an increase in DUI-related traffic collisions in the Newton geographic area of the Los Angeles Police Department.

Funding for these DUI saturation patrols comes from the California Office of Traffic Safety, through the National Highway Transportation Safety Administration. We can all help make our street safer. Report Drunk Driver – Call 9-1-1.
